Timeline | Music and plagiarism disputes
1971‘Folsom Prison Blues’ by Johnny Cash
In 1971, Johnny Cash paid songwriter Gordon Jenkins an out-of-court settlement of US $75,000 for plagiarizing liberally from Jenkins‘ 1953 song ‘Crescent City Blues’, for Cash’s 1955 single ‘Folsom Prison Blues’ (re-released in 1968).
1971‘My Sweet Lord’ by George Harrison
George Harrison was accused of plagiarism by music publisher Bright Tunes because of the similarities between ‘My Sweet Lord’ and Ronnie Mack’s ‘He’s So Fine’, a hit for The Chiffons in 1963. In the ruling, the judge stated that he believed Harrison had not intentionally copied the song, but more than likely experienced an episode of cryptomnesia.
1974‘Come Together’ by John Lennon
John Lennon’s use of a line from Chuck Berry’s ‘You Can’t Catch Me’ led to a lawsuit from Berry’s publisher, Big Seven Music Corp. In 1973, a settlement was reached whereby Lennon agreed to record three of Big Seven’s songs on his next album. Big Seven Music Corp. again sued Lennon for breach of contract, when his 1974 album, Walls and Bridges, failed to contain all three of the songs, with the court awarding the company US$6,795.
1992‘Creep’ by Radiohead
Radiohead were successfully sued for plagiarism over melodic similarities between their 1992 song and 1972’s ‘The Air That I Breathe’ by The Hollies. Consequently, The Hollies songwriters Albert Hammond and Mike Hazlewood are credited as co-writers.
1994‘Shakermaker’ by Oasis
Oasis were successfully sued for $500,000 by The New Seekers after the 1994 song ‘Shakermaker’ was found to have derived its melody from 1971’s ‘I’d Like to Teach the World to Sing’.
2011‘My Humps’ by Black Eyed Peas
The Black Eyed Peas were accused of unauthorised sampling the track ‘I Need a Freak’ by Lynn Tolliver. The composer claimed a former collaborator had licensed the track without his permission for the Black Eyed Peas hit ‘My Humps’. Tolliver won a $1.2 million pay-out.
2014‘Stairway to Heaven’ by Led Zeppelin
Led Zeppelin songwriters Jimmy Page and Robert Plant appeared in court to defend the allegation that they copied the iconic Stairway to Heaven opening from instrumental track Taurus by the band Spirit. Spirit’s Randy Wolfe died in 1997 and never took legal action, but his trustee, Michael Skidmore filed the law suit.
2015‘Blurred Lines’ by Robin Thicke and Pharell Williams
Marvin Gaye’s estate was awarded $4.9 million after Robin Thicke and Pharrell Williams were found guilty of plagiarising their monster hit ‘Blurred Lines’ from Marvin Gaye’s 1977 ‘Got to Give It Up’.
